Η εφαρμογή της διαβούλευσης στην Ελλάδα: Καλή πρακτική ή πρακτική με δυσλειτουργίες

Abstract

This work is an attempt to analyze the implementation of the consultation in Greece at the legislative level and to answer whether it works smoothly or presents malfunctions. The first chapter will attempt to record the historical development of the role of the citizen in the production of state policies through a prism of analysis of the concepts of legitimized power, the state based on the social contract and the crises of legitimacy it presents today. The second chapter will analyze public participation both as a decision making method and as an authoritarian mechanism. In this context, the classical and modern theories of democratic participation will be presented, as well as the democratic birth of law through the theoretical thinking of participatory democracy. The second chapter will close with the presentation of the modern "architecture" of democratic governance with reference to the modern concept of legitimacy that integrates Civil Society, international mobilization networks and the international financial forces of the market. Chapters 3 and 4 will present the consultation methods in countries with consulting experience, such as Canada, Germany and Belgium, in international organizations such as the UN, the EU and the OECD and in Greece, while in the chapter 5 will attempt the analysis of the consultation system through the use of opengov.gr mechanism and especially the case of the Ministry of Justice in the six years period, 2015-2020. The work will be completed with the presentation of the conclusions, as well as proposals for strengthening the institution of consultation.
