The managerial right of the employer is an inherent element of dependent labor. It
provides the employer with the ability to determine the type, the place, the manner
and the time of the work provided. Its legal basis is identified in the Civil Code and
the Constitution and is characterized as a formative, transferable and functional right.
Its practice is monitored by the courts in case of illegality or abuse. With the fourth
industrial revolution and the subsequent need for companies to move to the digital
economy, new business organization forms and new forms of employment are
emerging that liquidate fixed concepts of labor law. Remote work and digital control
and supervision of the employees’ capabilities affect the content and scope of the
managerial right. At the same time, new challenges and risks are created for the
personal data of employees, their labor rights and the assurance of the reconciliation
between their professional and private life.
