The communitisation of the international protection policy and the creation of the Com mon European Asylum System (hereinafter CESA) within the European Union (here inafter EU) has been a slow process, aiming at managing problems after the abolition
of internal borders pertaining to the reception of asylum seekers and the examination
of their relevant applications. The Dublin system is fundamental, as it sets the criteria
for determining the responsible Member State for examining the international protec tion applications.
The 2015 refugee crisis shook the CEAS and led to disputes between Member States,
which had political and secondarily judicial implications, most notably the rulings of
the Court of Justice of the European Union on the Hungary and Slovakia cases in rela tion with the mandatory relocation mechanism, and the failure to reform the Dublin
system over the last four years. The principle of solidarity and fair sharing of responsi bilities between Member States, as stated in Article 80 of the Treaty on the Functioning
of the EU is also closely intertwined.
